Terms of Service (General Terms and Conditions of Sale)

1. Scope

These General Terms and Conditions of Sale govern all purchases made through the CasaGalleria.ART website. By placing an order, the customer confirms that they have read and accepted them. The seller is Yuri Catania SA (UID CHE-418.911.386), with its registered office in Rovio (Municipality of Val Mara), Switzerland, operating through the CasaGalleria.ART gallery. 2. The artworks

All artworks offered are original works of art created by the artist Yuri Catania and accompanied by a certificate of authenticity. Depending on the series, each artwork is either a unique piece, existing in a single copy, or part of a numbered limited edition; the nature of each piece is stated on the relevant product page. As they are handmade, the artworks bear the marks of craftsmanship that attest to their making and uniqueness. The images published on the website reproduce each artwork as faithfully as possible; slight colour variations may result from the settings of the customer's display device and do not constitute a defect.

3. Prices

Prices are stated in Swiss francs (CHF) and apply to the artwork indicated. Any duties, taxes or customs charges applicable to international shipments are borne by the customer in accordance with the regulations of the destination country. CasaGalleria.ART reserves the right to change prices at any time; each order is subject to the price displayed at the time of confirmation.

4. Conclusion of the contract

The presentation of artworks on the website constitutes an invitation to make an offer and not a binding offer. The contract is concluded when CasaGalleria.ART confirms the order in writing (by email). As the artworks are unique, CasaGalleria.ART reserves the right to decline an order, with a full refund of any amount already paid.

5. Payment

Payment is made using the methods indicated when ordering. The artwork is prepared for shipping once the full amount has been received.

6. Retention of title

The artwork remains the property of Yuri Catania SA until the price has been paid in full.

7. Shipping and transfer of risk

Each artwork is carefully packed and insured for transport. Shipping times and costs are communicated when the order is placed and vary according to the destination. International shipments may be subject to customs formalities. The handling of transport damage is described on the Returns page.

8. Warranty and conformity

CasaGalleria.ART warrants that each artwork corresponds to the description published on the website, within the terms of Articles 197 et seq. of the Swiss Code of Obligations. As the artworks are made and finished by hand by the artist, any minor irregularities or imperfections do not constitute a defect: they are an integral part of the artwork and indeed add to its value, bearing witness to the artistic gesture and the uniqueness of each piece. Only damage occurring during transport constitutes a defect, and it must be reported promptly to hello@casagalleria.art as described on the Returns page. In all cases, damage resulting from improper handling, unsuitable display conditions or wear occurring after delivery is excluded.

9. Returns and cancellation

The conditions for returns, cancellation and refunds are set out in full on the "Returns, Cancellation and Right of Withdrawal" page, which forms an integral part of these General Terms and Conditions.

10. Intellectual property

The purchase of an artwork transfers ownership of the physical object only. All copyright and reproduction rights in the artworks and related content remain with Yuri Catania. Reproduction of the artworks and website content, in whole or in part, is prohibited without written permission.

11. Data protection

Customers' personal data are processed in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR), as set out in the Privacy Policy published on the website.

12. Applicable law and place of jurisdiction

Relations between CasaGalleria.ART and the customer are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and the rules of private international law. The place of jurisdiction is Lugano (Canton Ticino, Switzerland), subject to mandatory consumer protection provisions allowing consumers to bring proceedings at their own place of residence.
